Off-market and pocket listings, done right

Not every seller wants their house on the open market. Some don’t want neighbors walking through. Some have tenants they don’t want to disturb. Some are dealing with a death in the family, a divorce or a foreclosure date and want it handled quietly. For those sellers, an off-market sale can be the right call. Done carelessly, it can also cost them money and put you in a tough spot. Here’s how we see agents do it well across San Bernardino, Riverside, Los Angeles and Orange counties.

Start with what the seller actually wants

An off-market sale should be your seller’s informed choice, not a shortcut. Before you take a property quiet, walk your seller through the trade-off in plain language: fewer buyers see it, which usually means less competition, in exchange for privacy, speed or convenience. Some sellers will happily make that trade. Others will decide they would rather see what the open market brings.

Whatever they decide, get it in writing. Your broker will likely have a form or a process for documenting a seller’s direction to keep a property off the MLS or to limit marketing.

Know the rules before you go quiet

MLS and brokerage rules on office-exclusive and off-MLS listings have changed more than once in the last few years, and they can differ between MLSs. Before you market a property privately, confirm with your broker and your MLS what is allowed, what has to be disclosed, and whether there are time limits or filing requirements. This isn’t legal advice. It’s a reminder that the rules belong to your broker and your MLS, and they are the right people to ask.

Price it like it was public

The biggest risk in an off-market sale is a seller who later wonders whether they left money on the table. Protect them, and yourself, by doing the same pricing work you would do for a public listing:

  • Pull recent comparable sales, both as-is and remodeled.
  • Write down the repairs the house needs, with rough costs where you can.
  • Show the seller the difference between a retail price for a finished home and an as-is price for the house as it stands today.
  • Talk through what a financed buyer would need: inspections, appraisal, repairs and time.

When a cash buyer makes an offer, ask how they got to the number. We walk agents and sellers through ours: location, condition, the repairs it needs and what similar remodeled homes nearby have sold for.

Choose a buyer who won’t shop your deal

Off-market deals depend on trust. Sending the address to a buyer who turns around and markets it to a list of other buyers, or calls your seller directly, undoes the reason you kept it quiet. Before you send a property anywhere, ask:

  • Will you buy it yourself, or assign the contract to someone else?
  • Will you contact my seller directly?
  • Can you close with cash, and how fast?
  • Have you closed in this area before?

Our answers: we buy it ourselves, as a principal. We don’t market your deal, shop it, or go around you. The seller stays your client. We pay all cash with no lender or appraisal contingencies, and we close in about 7 days or on your seller’s timeline. Since 2011 our family has bought and sold 359 homes in 36 Southern California cities.

Keep the paperwork clean

An off-market sale still needs every disclosure a public sale does. As-is doesn’t mean undisclosed. Your seller still has to disclose what they know about the property. Keep your file complete: the seller’s written direction, your pricing work, the offers you received and how the seller chose. If anyone asks questions later, a clean file answers them.

Pocket listings that need a fast buyer

Some of the best off-market properties are the hardest to finance: fire damage, unpermitted work, tenants in place, or a house that hasn’t been touched in forty years. Those are the deals we look for. Our post on hard-to-finance listings goes deeper on each one.
